Terms and Conditions of Sale
- Indoor Housing: The Purchaser agrees to provide adequate indoor housing for the Cat/Kitten and will not permit unsupervised outdoor roaming or access beyond a secure enclosure.
- Health and Sanitary Conditions: Should the Cat/Kitten’s health deteriorate or its living conditions become unsanitary, the Purchaser shall immediately and unconditionally surrender the cat to the Seller.
- Transfer of Ownership: The Purchaser agrees not to sell, lease, or give away the Cat/Kitten without the Seller’s prior written consent. The Cat/Kitten shall not be transferred to any research facility, animal shelter, pet shop, or similar establishment. The Seller retains the right of first refusal should the Purchaser wish to rehome the cat.
- Pet Purchase: This Cat/Kitten is sold as a pet unless explicitly designated otherwise in a written agreement signed by both Seller and Purchaser.
- Spay/Neuter Agreement: If purchased as a pet, you will usually receive a fixed cat. In rare cases when the cat isn’t fixed, the Purchaser agrees to spay/neuter the Cat/Kitten by ten (10) months of age, or within ten (10) days of purchase if the cat is an adult. The Purchaser guarantees not to breed this cat. Failure to provide veterinary proof of spay/neuter by the specified deadline will result in a $3,000.00 penalty per litter sired or bred. No breeding rights or CFA pin code will be provided, regardless of spay/neuter status.
- Declawing Prohibition: The Purchaser agrees not to declaw the Cat/Kitten.
- Health Warranty: The Seller warrants the Cat/Kitten to be in good health to the best of their knowledge and free from hereditary diseases for one (1) year from the date of purchase.
- Veterinary Examination: The Cat/Kitten must be examined by a veterinarian within seventy-two (72) hours of purchase. Failure to comply will void all health warranties.
- Disease Exclusion: Health warranties are void if the cat contracts any zoonotic or communicable disease after the purchase date.
- Hereditary Disease Claims: To claim a life-threatening hereditary disease, written diagnoses from three (3) veterinarians from different organizations are required. The Seller reserves the right to have their veterinarian examine the Cat/Kitten. If the claim is validated, a replacement kitten will be offered, subject to availability. No other compensation will be provided.
- Necropsy Requirement: In the event of the kitten’s death within one (1) year of purchase, and a veterinarian suspects a congenital, hereditary, or pre-existing condition, a necropsy conducted by a County of Tarant veterinarian (or equivalent state facility) is required at the Purchaser’s expense. Failure to obtain a necropsy will void all health warranties, and no replacement will be offered.
- No Refunds or Exchanges: All sales are final. No refunds or exchanges will be granted.
- Show/Breeding Quality: The Seller makes no warranties regarding show quality or breeding potential unless explicitly stated in a separate written agreement.
- General Provisions: Failure to comply with any of these terms and conditions renders all health guarantees null and void. This agreement is governed by the laws of the State of Texas. All obligations are performable in the country of the Seller’s residence at the time of any dispute. Any violation of these terms constitutes a breach of contract, and the Purchaser will be liable for all resulting damages and court expenses, including attorney fees.
